1. Agreement
These Terms govern your use of the CareTail iPhone app and the caretail.app website (the "Service"), provided by Individual Entrepreneur Fedar Trukhan, registered in Georgia, 2 Sanapiro Street, Tbilisi 0114, Georgia ("we", "us"). You accept these Terms when you agree to them in the app, for example when you sign in or create an account, or when you buy a CareTail Pro subscription. Apple's Licensed Application End User License Agreement (the "Standard EULA") also applies to the app. If these Terms and the Standard EULA conflict, the Standard EULA prevails for the app licence. Our Privacy Policy explains how we handle personal data.
2. The Service
CareTail helps you organise your pets' care: routines and reminders, a care log, weight, a medical card, documents, contacts, a photo diary and family sharing. CareTail is not a veterinary service. Information in the app, including reminders and weight notices, is not veterinary advice and does not replace a veterinarian. In an emergency, contact a veterinarian immediately.
3. Accounts
You can use CareTail without an account; your data then stays on your device and is not backed up by us. To sync and back up your records you can sign in with Apple, Google or an email sign-in link. Keep access to your sign-in method secure; you are responsible for activity under your account. You must be at least 16 years old to create an account. You can delete your account at any time in the app (More › Delete account).
4. Your content
You keep all rights to the records, photos and documents you add ("your content"). You give us a limited, non-exclusive licence to store, copy, process and display your content only as needed to provide the Service to you and to the family members you share it with. We do not use your content for advertising and do not make it public. You are responsible for having the right to add your content, including information and photos of other people, and for its accuracy.
5. Family sharing
Members of a family can see and edit the family's pets and records. The family owner manages membership and can transfer ownership to another member. When a member leaves or deletes their account, the family's shared records stay with the remaining members. Invite only people you trust.
6. CareTail Pro subscriptions
- CareTail Pro is available as an auto-renewable subscription (monthly or yearly) bought through the App Store. The price and period are shown before you confirm the purchase; prices are set by the App Store for your country and may include taxes.
- Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel the subscription in your iPhone's Settings › [your name] › Subscriptions. Cancelling stops future renewals; you keep Pro until the end of the paid period.
- If a free trial is offered, the subscription starts automatically when the trial ends and you are charged, unless you cancel at least 24 hours before the end of the trial. Any unused part of a free trial ends when you buy a subscription.
- A Pro subscription can cover the members of your family while you are a member.
- Purchases are made through the App Store and processed by Apple. Apple's terms apply to them, including any statutory right of withdrawal you have and Apple's refund process. Withdrawal and refund requests go to Apple (reportaproblem.apple.com). Nothing in these Terms limits your rights under Apple's terms or mandatory consumer law.
- When Pro ends, your photos, documents and records are not deleted. Features that need Pro, such as uploading new photos or adding documents, stop until you subscribe again.
7. Acceptable use
Do not misuse the Service: do not break the law, upload unlawful content or malware, try to access other people's data, interfere with or overload our systems, or reverse-engineer the app except where the law allows it.
8. Availability and changes
We work to keep CareTail available and your data safe, but the Service may occasionally be unavailable or change. We may add, change or remove features; if a change materially reduces what you paid for, we will tell you in advance. We keep backups, but you are encouraged to use More › Export my data to keep your own copy.
9. Ending
You can stop using the Service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaches these Terms, after notice where reasonable. Subscriptions bought through Apple continue until you cancel them with Apple.
10. Liability
To the extent permitted by law, the Service is provided "as is" and "as available", and we are not liable for indirect or consequential losses, for decisions about your pet's health made on the basis of information in the app, or for losses caused by events beyond our reasonable control. Our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.
These limitations do not apply to our liability for intent or gross negligence, for injury to life, body or health, or under product liability laws. Nor do they apply to a breach of an essential contractual obligation, meaning an obligation that makes providing the Service possible in the first place and on which you may regularly rely; if we breach such an obligation through slight negligence, our liability is limited to the damage that is foreseeable and typical for this kind of contract. Nothing in these Terms limits liability that cannot be limited by law or affects your mandatory statutory rights as a consumer, including those of your country of residence.
11. Governing law
These Terms are governed by the laws of Georgia, and disputes go to the courts of Tbilisi. If you are a consumer with your habitual residence in the EU, or in another country whose law gives consumers mandatory protection, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may also bring a claim in the courts of your country of residence. If you are a consumer in the EU, we can bring a claim against you only in the courts of your country of residence.
12. Changes to these Terms
We may update these Terms, for example to reflect changes in the law or in the Service. We will change the date above and tell you about the changes in the app or by email at least 30 days before they take effect; changes required by law, or that only benefit you, may take effect sooner. If you do not agree, you can end the agreement before the changes take effect by deleting your account and cancelling your subscription. We will not make changes that materially disadvantage you without your agreement, except where the law allows it.
